1) Box’d Night In Pty Ltd (ABN 91 647 099 983) (“Box’d Night In”, “we” or “us”) cares out about the privacy of its visitors and users (“you” or “your”) and treats personal data provided to us with respect and integrity. Respect and integrity form part of our core values, which form the foundation for the way in which we conduct our business. We are committed to protecting your privacy and it is important that you understand how we look after your personal data.
What information do we collect?
7) Whilst carrying out our business operations, Box’d Night In will collect personal information about you.

12 ) We may collect this information when you enquire about us or require any of our services. However, if you elect to provide unsolicited sensitive information, it may be captured and stored.

13.3) when you visit one of our job sites;
13.4) if you apply for employment or other type of engagement with Box’d Night In;

15.17) to process and obtain payment for any products or services you order from us through the Website, or this may be done by or through our third party payment gateway provider from time to time, which is currently Stripe (www.stripe.com/au);
16) We may use the information collected to provide advertising on the Website or on other sites or mediums, either ourselves or through a third party.
How do we protect your information?
18) We implement a variety of security measures to maintain the safety of your personal information when you place an order or enter, submit, or access your personal information.
19) All supplied credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our Payment gateway providers database only to be accessible by those authorised with special access rights to such systems, and are required to keep the information confidential.

21) When you visit the Website, we may assign to your Device one or more cookies to facilitate access to and use of the Website. A cookie is a piece of information that allows the service to identify and interact more effectively with your Device. Do we disclose any information to outside parties?

28) If you access the Website from a third-party social platform, such as Facebook, Instagram, Google+ or LinkedIn, we may share non-identifiable information with that platform to the extent permitted by your agreement with that platform and its privacy settings.

29.2) companies that provide information and infrastructure systems to us;

29.4) anyone, where you have provided us consent;

29.7) organisations that provide products or services used or marketed by us.
30) Prior to disclosing any of your personal information to another person or organisation, we will take all reasonable steps to satisfy ourselves that:
30.1) the person or organisation has a commitment to protecting your personal information at least equal to our commitment; or
30.2) you have consented to us making the disclosure.
31) We may use cloud storage to store the personal information we hold about you. The cloud storage and the IT servers may be located outside Australia. We may disclose your personal information to overseas entities.
32) Box’d Night In may, from time to time use your personal information for the primary purpose of providing you with our services. We may use your personal information to send newsletters relating to Box’d Night In and relating legal issues that may be of interest to you. This includes sending you information about new developments, products, services, legal updates and special offers. You authorise us to use any email address or other contact information you provide to us at any time for this purpose.
33) You agree and acknowledge that even if you opt out of receiving marketing material, we will still send you essential information that we are required to send you relating to our business agreement. If you do not wish to receive commercial electronic messages from us, please use the unsubscribe facility or contact our office on firstname.lastname@example.org.
Updating your personal information
34) It is important that the personal information held by us is up to date and accurate.
35) We may ask you to notify us if any of your personal information has changed. If you wish to make any changes to your personal information, please contact us. We will generally rely on you to ensure the information we hold about you is accurate or complete.
Access to your personal information
36) You may access the personal information we hold about you and to update and/or correct it, subject to certain exceptions. If you wish to access your personal information, please contact us in writing.
37) Box’d Night In will not charge any fee for your access request but may charge an administrative fee for providing a copy of your personal information.
38) In order to protect your personal information, we may require identification from you before releasing the requested information.
39) Box’d Night In has security measures in place to help safeguard your identifiable personal information from unauthorised access or disclosure. However, no system can be completely secure. Therefore, although we take steps to secure your information, we do not promise, nor should you expect, that your personal information will always remain secure.
40) We will notify the Privacy Commissioner if we reasonably believe that your personal information has been subjected to a data breach that is likely to result in serious harm to you. A data breach occurs where there is unauthorised access to or disclosure of personal information.
41) We will generally notify you if we reasonably believe that your personal information has been subjected to a data breach if:
41.1) there is a risk of serious harm to you; or
41.2) Box’d Night In is otherwise legally obligated to notify you.
42) We may also notify other third parties of a data breach where appropriate.
43) Our liability to you in respect of any security breach or accidental loss or disclosure of your information or data is hereby excluded to the maximum extent permitted by applicable law.
44) If you have any concerns or would like to raise a complaint regarding the way your personal information is managed by us or believe that a breach of your privacy has occurred, please let us know by contacting us.
45) If you are dissatisfied with the response of our complaints officer, you may make a complaint to the Privacy Commissioner which can be contacted via the Office of the Australian Information Commissioner website (www.oaic.gov.au) or on 1300 363 992.
